Santa Barbara Sheriff Sued For Sexual Harassment, Then Resigns

The facts in this case don't add up. At least not after the Sheriff's prolonged pursuit and the Complainant's complicit behavior to get ahead.  Yes, the Sheriff was committing sexual harassment initially, and used his position of power to get what he wanted, if true, yet, at what point does the victim need to be accountable and lose her rights to claim harassment?

Law School Dean Lawrence Mitchell Is Sued by Law Professor Raymond Ku For Retaliation: Ku Reported Mitchell's Sexual Harassment

In this instance, a former law school associate dean, Raymond Ku, has filed a lawsuit against Case Western Law School and its Dean, Lawrence Mitchell for retaliating against his reporting Mitchell to the school's provost, vice president for diversity and faculty diversity officer.

Ku, the University has retorted, has not suffered retaliation, as he is a full tenured full-time faculty at the law school.

I'm sure we all know that even if you still have your position, there are many ways an employee can be discriminated against and tormented, even if they are not terminated.

Without knowing all the facts regarding the lawsuit, it is interesting to see that an informant, not the victim, is coming forward with allegations, and still, suffers the same consequences.

Thomas v. Shavolian: Complaint Alleges He Fondled Her Breast In Interview. What????

Steven Fife, Horace Mann Sex Abuse Victim Cannot Put Sex Harassment Behind Him - He Made Claim After Claim

Fife was told that coming forward with his allegations of attempted rape by his English teacher in the 70's would "hurt his chances of getting into a good college..."  The stories are usually the same, whether it's an employee who needs the job, a former employee who needs the recommendation, or a student who needs a good grade.  Victims have been and continue to be intimidated into keeping silent, and the predators continue to prey on the vulnerable.

Gloria Allred: Where Were You When We Needed You?

On CNN this morning, Allred talked about her client and the other Bob Filner victims of his sexual harassment.  She told CNN that mediation in front of a retired federal court judge on behalf of Irene McCormack Jackson precipitated his imminent resignation.  Allred stated that had Jackson not come forward with her lawsuit, Filner would still be engaging in his illegal behavior in the Mayor's office to this day.  Allred is 100% correct!

Speaking of Bob Packwood… 
The writers of this blog were contacted by our former boss, AKA,  "The Animal," in November, 1992...

After both of us resigned from our positions as Assistants to The Animal in early 1992, we tried, as difficult as it was, to move forward and put the sexual and emotional abuse behind us.  It wasn’t easy, but new jobs in new companies eased the pain.

I stayed in Hollywood, and went to work for a great company with great people, as a Director of Marketing.  My partner on this blog, left for Europe where she got a job in the International Division of a movie studio. Still good friends, we communicated via email almost every day.

The receptionist at my new job rang my buzzer one early afternoon and announced that, The Animal, CEO from the Movie Studio, was on the phone for me.  The call was a surprise.  It was unexpected.  Although the headlines in the paper that morning gave me a hint as to the reason I was on his mind.
Even after you leave a traumatic situation, the feelings always seem to pour into you like waters flowing in at high tide, the instant any connection to the trauma hits you.  What could hit you like a brick on the head more than the actual perpetrator calling for you, when you’ve been able to escape from his power and control, in your new safe environment?

Thus, when the receptionist announced his call, I promptly replied, “take a message.”

Now, at that time, in his career, not many people turned down The Animal’s calls.  I knew, on the other end of the line, his poor “new” assistant, would have to bare the brunt of his rage, when learning that I would not be available to him when he phoned. “What do you mean, she’s not available? Was she there? Is she in a meeting? GET HER ON THE PHONE!” I could hear the screaming in my head, as I knew the routine perfectly. I felt badly for the new “girl” but was overjoyed that it wasn’t me making the calls for him.  I’d escaped.

I could just see him in his office, with the new girl at his side, waiting to write down his every word as he’d pace back and forth and yell and scream and demand that I remain on his phone sheet until she was able to reach me for him. He was like a tiger after its prey and for the moment, I was something he needed to pounce on and obliterate.

I had seen the headlines that day.  I knew that Senator Bob Packwood was being accused by staff member after staff member of sexual harassment as well as lobbyists.  It was all over the press.  It was on every news station.  After Anita Hill/Clarence Thomas, this was the biggest story to break about sexual harassment concerning someone in a very powerful position in the U.S. Government, who was being accused of reprehensible behavior against the women he worked with.

I figured, The Animal must be calling me because he’d seen the headlines, and was worried sick that, since I was within the statutory period in which I could file a claim against him, his lewd and unlawful acts may be made public.  Perhaps, if I too would read the newspapers or see the news, and was smart like him, maybe I would seize the opportunity to come forward and expose his disgusting and harassing behavior that he’d participated in for the two years that I worked for him.  

Then I thought, no, that’s so obvious.  No one would be that transparent.  If he was really calling about that, he’d at least wait a week or two.  Clearly calling the day the Packwood situation made the headlines was much too pathetic.  Especially for such a clever smart studio head, like The Animal.
I sent an email to my partner, in England.  I told her he’d called.  What do you know?  He’d e-mailed her on the same day.  He told her he was just checking in, that he missed her, etc.

I was flabbergasted.  Yes, he was checking in on his victims…  Making sure we were in no way plotting our revenge, planning a law suit, seeking restitution and justice for his unlawful behavior.  

So, I waited a day, and called him back.

After very brief hellos and how are yous were exchanged, I asked him, so, “why is it that you are calling?”
His answer in his thick Mickey Donovan accent, “You know honey, sweetie, you are missed here. You need to come and visit us here at the studio and give me a big hug.  You know, that wouldn’t be sexual harassment don’t you?”

I was disgusted by his attempt to feel me out, and make such an overt attempt at discovery.  He really did think I was a complete fool.  

Problem was, that then, with my whole career in front of me, and my applications to law school waiting to be completed on my desk, applications that required letters of references from previous employers like The Animal, I felt stuck, trapped and helpless. How could I, how could we come forward and expose him?  This was a time before reality TV and social media made it acceptable to air each and every shameful and embarassing life event.  This was a time when "You'll Never Eat Lunch In This Town Again" was perceived as a career ending publication for it's author, Julia Phillips.  Clearly, our perception at the time was that if we did expose The Animal, we would not only not eat lunch in town again, but that we would be unemployable for many years to come.

Richard Nanula - sex addict or sexual harasser? Is there a difference?

We all know the game. Even Ray Donovan shows how it works in the new Showtime series. Star caught in sexually compromising position, even criminal position, and the way to redemption is through rehab.

But, when corporations are reluctant to act immediately when a mogul goes awry, shouldn't they be held responsible.  The PR team launching its "sexual addiction" rehab releases surely don't repair the damage created by an executive that most likely ran rampant for years exhibiting unlawful and debilitating behavior.  Certainly Ms. Shaw wasn't the first to report.  Or maybe she was.  It takes a very bold person to report to HR, the behavior of the powerful head honcho.

George Chopek of Cumberland County Prosecutor's Office, sued for Sexual Harassing female Detective

Despite Lynn Wehling's claims of harassment, nothing was done to discipline Chopek.  Wehling, a gay detective, claims that Chopek referred to her sexuality and continually referred to her as a "guy," and "dude," including doing so in front of inmates that they were transporting during their work together.  In addition, Chopek allegedly commented on her female friends, insinuating that they were lovers, and commenting on the size of their breasts.

So, when this case is settled out of court, who do you think will pay?  NJ taxpayers of course!

Sexually Harassed Nanny

A friend's nanny came to us with a story the other day. Her nanny works part time for another family in the early mornings.  It just so happens that when she works for that family, the mom is usually not home when she arrives, just the dad.

She told of the dad's behavior and asked, is this behavior appropriate, because I feel weirded out.  

Firstly, if you feel "weirded out," then the behavior is most likely inappropriate.   But, just to make sure, we asked for details. 

She told us that even though she'd worked for the family for many months, the husband had virtually ignored her existence.  He'd never spoken to her, nor had he ever even gazed in her direction. Yet, in the last two weeks, he'd begun to actually speak to her.  However, the speech was often accompanied by a brush of her leg by his wandering hand, or a strange incidental contact with her shoulder as he sauntered up to her by the sink.  

At first, she recounted, she thought the physical contact was accidental. But, as his contact with her became more frequent, he began to talk to her about her physical appearance.  

As she told us this information, it became obvious that this guy was sexually harassing the nanny.  

She felt uncomfortable that he noticed how her "pink blouse flattered her curves," to the point that she felt dirty and wanted to go home and change her blouse.  

The question was, what could she do?  Well, any action she took would most likely cause her to lose her job.  I recalled the scene from The Nanny Diaries, when the sleazy cheating husband noticed the namny for the first time, despite her year of employ, and quickly pounced on her ass.

Go to the wife? How would that pan out?  Confront the husband?  Well, that would most likely be met with a, "gee, you're so sensitive, I was just complimenting you."

Likely, this financial executive engages in the same type of conduct at his job in the City.  No doubt the women he works with have to deal with his same crap. Or do they?

Jazmina Inserillo alleges that after complaining of her Lt.'s sexual harassment, she was ordered to go to rehab for her drinking. When she refused, she was disciplined and suspended.

When Should You Turn Down the Job

Big Warning Signs that You Shouldn't Take the Job, or when you should quit.

1) He touches your hand and tells you, "see this hand?", then points to his head, then says, "my brain, tells this hand what to do."  "You are my right hand, get it?"

2) He walks in the room and says nothing, just stares.

3) He tells you you will have to use sexual prowess to accomplish any tasks he assigns, if that is what it takes to get the job done.

4) During you first week on the job he asks, "would you go to a movie with me sometime."

5) When you try to quit, he promises you a bonus and a promotion.

6) When you walk into his office he calls you a hot number.

7) When you accompany him to a meeting he describes the many ways he'd sexually violate a young woman passing by.



No matter how bad the job market is, how powerful your boss is, how young and inexperienced you are,  no matter how many student loans you have to pay back, nothing is worse for you than to remain in a position where you are demoralized and abused.

QUIT... QUIT... QUIT...

But report him or her first.  File a complaint with HR.  Depending on what happens with HR, you may need to proceed quickly to the EEOC and file a Title VII claim.

Flashback 1986 - Canastel's Restaurant NYC and a First Encounter with Sexual Harassment

A Freshman at NYU and all of 17, living in the big city.  She received scholarship money and loans, but not nearly enough to sustain a lifestyle of daily cab fare and food outside of the dorms.  What was a girl to do?  Well, start by going out to dinner to celebrate your 18th birthday with your roommate at one of the “hottest” spots in town, Canastel’s.  It was September, 1985, the mid-80’s.  Wall Streeters, garment center bozos, celebrities all flocked to 19th Street and Park Avenue South to wait in line for a table at Marc Packer’s fabulous Italian restaurant.  Unless you were Steve Perry from Journey, or Prince (the Artist formerly known as Prince, or is he Prince again, I’m not sure), you waited for a table. 
Her roommate made a reservation, and they were met at the door by a hostess that bleakly advised them that their table for their 8 p.m. reservation was not ready, but to please have a drink at the bar.  They were teens, but that didn’t matter, looks alone got you alcohol back then.  So they drank, and they waited.  By 9:15, they were seated at their small deuce and were eager to feast on exorbitantly priced fresh arugala and shaved parmesan and pasta pomodoro. 
When a bald man in an exquisite suit and a beaklike nose,  swooped down on their little table and asked how they were enjoying their food, she looked up and in her most sophisticated voice uttered, “it’s fabulous.”
He replied, as he eyed her up and down, “Do you need a job?  I’m Marc and I own the place.”  She then flipped her 80’s hair back, and said, lying, “I’ve been looking for a job for the longest time.”  Truth be told, she wanted a job for the past three weeks, but hadn’t as much as ventured to the job boards at the student union once to try to find one.  First semester was tough, and she wasn’t sure she could handle the pressure of work and school.
He asked her to stand up.  Surprised, but game, she did.  He then twirled her around.  “You’re hired.”
This was the start of an eight month stint at Canastel’s as a hostess during which time Marc Packer and the restaurant’s Maitre’d, Moreno, had both, at one time or another, managed to pin her against the counter in the back kitchen on more than one occasion, and forced their tongues into her mouth.  The money was so good, with the tips from the cigarette sales and the coat check, that it was impossible to quit.  All the girls endured the harassment.  The waitresses, Sandra Bullock included, all were treated like geishas.  It was her first experience in the working world, and unfortunately, not the only one where she was treated like an object.

Why is it that young women still seem to think that enduring such treatment is akin to "paying your dues?"

Male on Male Sexual Harassment Case Can Go Forward

Senaca Foods Corp. sued by Male employee alleging that he was sexually harassed by male superior.  Comments were made to him like, "suck my dick," etc.  Jeffrey Barrows also alleged that his male supervisor had sexually harassed him by touching his genitals and creating a hostile work environment. 

Although there was no allegation that the Defendant employer, Victor Sanabria, was gay, or that Mr. Barrows, the Plaintiff was gay, the complaint alleged that the unlawful behavior by Sanabria was always directed at male employees.

What was this guy thinking?  The plaintiff, law graduate, Sabrina Rafi, says she was terminated after she reported this sleazy guy's behavior.  Allegedly into polygamy and being fed Korean food with chopsticks, Mr. Ray thought he could request that his young female paralegal should oblige him with these unusual requests.  Poor young woman never thought this would be a job requirement in Torts.  Shame on him, if true. Click here for the article

It's been a bit more than twenty years since I worked for the Animal.  Animal is the term we used for him.  Why did we call him the Animal?  Because he behaved like one.  I'd never seen a man so constantly grab his crotch area through his jeans and maneuver his junk.  This Chairman and CEO would scream at the top of his lungs about any minor detail (a busy phone line, a 10 cent discrepancy on a bill for reimbursement, a five second delay in a ringing phone line, etc.)..  He'd throw a tantrum if someone ate one of his cookies, and most importantly, dominated everyone around him with his aggression and power.  This is not to mention his vulgar and disgusting behavior of a sexual nature, which I won't go into now.

Yet, what is the reason that we never came forward? 

I still have difficulty writing anything about those two years.  It's as if the trauma is so deeply ingrained, that to bring it all up again would create more anger and frustration about my silence during the term of Harassment.

I recall one incident vividly that happened not too long after I began working at the Studio.  The incident didn't even involve the Animal directly, but his Co-Chairman and Co-CEO.  The incident was even more despicable, in my mind at the time, ironically, because I didn't even work for the Animal's partner, yet he too thought he could harass. 

It was a regular morning in the Executive Offices of the movie studio.  I was running out of the Animal's office to perform some task he'd assigned in his office the second before.  As I walked past the front reception desk on the way to my office, his partner, his co-Chairman and co-CEO, slapped my behind.  I was confused, shocked, humiliated, embarassed and objectified.  I had left the door open to the Animal's office when I'd left, and instinctively turned around to see if I'd get any look of sympathy or support from my boss, and if in fact the Animal  had seen his partner touch my bottom.  He had, and I saw the smirk on his face, almost like he was thinking, "Gosh, I wish I'd done that."  Then, as the butt-smacker walked toward the Animal's office for his meeting, he yelled out, "Honey, those pants are too tight."

The angry feeling I had felt a moment earlier disappeared.  All of the sudden, I thought, "Shit, it's my fault, my pants are too tight."  I went from being the victim to the perpetrator in less than ten seconds. 

I was no longer angry at the men who were treating me like a two bit hooker, I was mad at myself.   I shouldn't have worn those cream colored slacks.  How crazy of me to dress in fitting slacks with a nice blouse to work.  I brought his behavior upon myself. 

This was how they got you.  Their manipulative tactics, so subtle, yet so effective. 

Clearly, there were many other reasons to refrain from reporting the pervasive abuse that took place.  However, when you work for the big boss, there is, one most likely feels, nowhere to turn.  That was how I felt then.  I know now how wrong I was.

The athlete and his team owners are all implicated in fostering an environment in which the Plaintiff was sexually harassed.  The team settles.  The player plays, his owners play along, and they buy their way out of the mess they fostered.  But does this system do anything to curb future "bad" behavior?

Here they are: the new owners of the team.  Does the crowd know they just forked over an unknown amount of money to settle a lawsuit agains them for sexual harassment?  Do they care?  Probably not.
